Texas eBike laws and route permission

Section 664.001 of the Texas Transportation Code defines an electric bicycle as a bicycle with fully operable pedals and an electric motor of fewer than 750 watts, with a top assisted speed of 28 miles per hour or less. A class 1 electric bicycle assists only when the rider is pedaling and has a top assisted speed of 20 miles per hour or less. A class 2 electric bicycle may propel the bicycle without pedaling and has a top assisted speed of 20 miles per hour or less. A class 3 electric bicycle assists only when the rider is pedaling and has a top assisted speed of more than 20 but less than 28 miles per hour. See Transportation Code Chapter 664.

Section 664.004 says a person who manufactures or sells a class 3 electric bicycle shall ensure that the bicycle is equipped with a speedometer. Section 551.107 says a person may not operate a class 3 electric bicycle unless the person is at least 15 years of age. A person under 15 may ride on a class 3 electric bicycle as a passenger. The electric motor must disengage or cease to function when the operator stops pedaling or when the brakes are applied. These sections do not set a statewide electric-bicycle helmet rule.

Section 551.106 says the department or a local authority may not prohibit an electric bicycle on a highway used primarily by motor vehicles, or in an area where a nonelectric bicycle is permitted, unless the area is a path that is not open to motor vehicles and has a natural surface tread made by clearing and grading the native soil. A local authority may prohibit a bicycle on a sidewalk. Confirm the posted rule for the county segment before you ride. See Transportation Code Chapter 551.
