O.C.G.A. § 40-1-1(15.3) defines an electric assisted bicycle as a device with two or three wheels, a saddle, and fully operative pedals for human propulsion, plus an electric motor with a power output of not more than 750 watts. O.C.G.A. § 40-6-300 splits that device into three classes. Class I assists only while the rider is pedaling and ceases at 20 miles per hour. Class II may be used exclusively to propel the vehicle and is not capable of reaching 20 miles per hour. Class III assists only while the rider is pedaling and ceases at 28 miles per hour.

O.C.G.A. § 40-6-301 gives the operator of an electric assisted bicycle the rights and duties of a bicycle operator under Title 40, except where this part says otherwise. O.C.G.A. § 40-6-302 requires a device manufactured on or after January 1, 2020 to carry a permanent label naming the class, the motor wattage, and the top assisted speed. The motor must be capable of disengaging when the operator stops pedaling or applies the brakes. A Class III electric assisted bicycle must have a speedometer that displays speed in miles per hour.

O.C.G.A. § 40-6-303 says a Class I or Class II electric assisted bicycle may be operated on a bicycle path or shared-use path where bicycles are permitted, unless the local authority or state agency with jurisdiction prohibits that class. A Class III electric assisted bicycle may not be operated on a bicycle path or shared-use path unless the path is within or adjacent to a highway, or the local authority or state agency permits it. On a natural-surface path made by clearing and grading native soil with no added surface materials, those path limits do not apply, and the local authority or state agency may still regulate which devices are allowed. No person under the age of 15 may operate a Class III electric assisted bicycle. A person under 15 may ride as a passenger on a Class III electric assisted bicycle designed to accommodate passengers. No person may operate or be a passenger on a Class III electric assisted bicycle without wearing a bicycle helmet. Trail access remains manager-specific.
