Florida Statutes 316.003(23) defines an electric bicycle as a bicycle or tricycle with fully operable pedals, a seat or saddle for the rider, and an electric motor of less than 750 watts that meets one of three classes. Class 1 assists only while the rider is pedaling and stops assisting at 20 mph. Class 2 may propel the bicycle without pedaling and stops assisting at 20 mph. Class 3 assists only while the rider is pedaling and stops assisting at 28 mph. That Class 3 definition does not require a speedometer.

Florida Statutes 316.20655 gives an electric bicycle and its operator the rights and duties of a bicycle and a bicycle operator, including section 316.2065, and says an electric bicycle is a vehicle to the same extent as a bicycle. An electric bicycle is not subject to financial responsibility, driver or motor-vehicle licence, registration, title, off-highway motorcycle, or off-highway vehicle rules. A local government may adopt a minimum-age ordinance or require a government-issued photo identification. Those are local options, not a statewide Class 3 age ban. Florida Statutes 316.2065(3)(d) requires a bicycle rider or passenger under 16 to wear a properly fitted and fastened bicycle helmet meeting 16 C.F.R. part 1203. Because section 316.20655 incorporates section 316.2065, that under-16 helmet rule reaches an electric-bicycle rider or passenger.
