Wyoming uses a three-class electric bicycle definition in W.S. 31-1-101(a)(xxxiv): fully operable pedals, a seat or saddle, and an electric motor of less than 750 watts. Class 1 is pedal-assist that cuts off at 20 mph. Class 2 may propel without pedaling and is not capable of assistance at 20 mph. Class 3 is pedal-assist that cuts off at 28 mph. An electric bicycle is not a motor vehicle.
Under W.S. 31-5-707, an electric bicycle operator is subject to the bicycle rights and duties in W.S. 31-5-702 and is not subject to this title's rules on financial responsibility, driver's licenses, registration, certificates of title, or off-road recreational vehicles. Manufacturers and distributors must affix a class, top assisted speed, and motor-wattage label. Do not modify speed capability without replacing that label. The motor assist must cease when you stop pedaling, apply the brakes, or disengage the motor.
W.S. 31-5-707(f) lets a local authority or state agency with jurisdiction regulate any class of electric bicycle on trails, including nonmotorized trails, under its jurisdiction. A nonmotorized trail means a natural surface made by clearing and grading native soil with no added surfacing materials.
