Code Ann. § 56-1-10 defines an electric-assist bicycle, also called a bicycle with a helper motor, as a two- or three-wheel machine with fully operable pedals, an electric motor of no more than 750 watts, and a top motor-powered speed under 20 mph with a 170-pound rider on a paved level surface. It must meet 16 C.F.R. Part 1512. The motor must cut out when you brake or stop pedaling. A manufacturer label showing wattage and max assisted speed stays on the bike. That machine is not a moped. A 28 mph Class 3 sticker from another state does not put you inside this definition.

S.C. Code Ann. § 56-5-3520 gives a qualifying helper-motor rider the same rights and duties as a bicyclist under § 56-5-3420. No statewide license, registration, or insurance for a machine that matches § 56-1-10. Hilton Head, Charleston, Myrtle Beach, and county parks still post their own path, boardwalk, and beach hours.
