It must meet 16 C.F.R. Part 1512. The motor must cut out when you brake or stop pedaling. A manufacturer label showing wattage and max assisted speed stays on the bike. That machine is not a moped. A 28 mph Class 3 sticker from another state does not put you inside this definition.
