Class 1 assists only while you pedal and cuts off at 20 mph. Class 2 may assist whether or not you pedal and cuts off at 20 mph. Class 3 assists only while you pedal and cuts off at 28 mph. The motor may not exceed 750 watts. A machine that does not meet that definition and can exceed 20 mph on motor power alone is an electric mobility device, not an e-bike.
NMSA 1978 § 66-3-708 requires a permanent class label with top assisted speed and motor wattage in at least nine-point Arial. Do not modify speed or motor engagement without replacing the label. Class 2 must cut the motor when the brakes apply. Class 1 and Class 3 must cut the motor when you stop pedaling.
