Class 1 is pedal-assist that stops at 20 mph. Class 2 may assist whether or not you pedal and stops at 20 mph. Class 3 is pedal-assist that stops at 28 mph. An electric bicycle is a bicycle under §11-104.
Md. Code, Transp. §21-1205.2 lets that machine travel where bicycles may travel, including bike lanes, unless a local authority or State agency with path jurisdiction posts otherwise. Class 1 and Class 2 may be banned on a bicycle path by that authority. Class 3 may not use a bicycle path unless the path is within or adjacent to a highway right-of-way or the authority allows it.
