Maryland eBike rules snapshot

Maryland uses three electric bicycle classes. Md. Code, Transp. §11-117.1 defines an electric bicycle as a vehicle designed to be operated by human power with motor assistance, fully operable pedals, two or three wheels, a motor of 750 watts or less, and one of three classes. Class 1 is pedal-assist that stops at 20 mph. Class 2 may assist whether or not you pedal and stops at 20 mph. Class 3 is pedal-assist that stops at 28 mph. An electric bicycle is a bicycle under §11-104.

Md. Code, Transp. §21-1205.2 lets that machine travel where bicycles may travel, including bike lanes, unless a local authority or State agency with path jurisdiction posts otherwise. Class 1 and Class 2 may be banned on a bicycle path by that authority. Class 3 may not use a bicycle path unless the path is within or adjacent to a highway right-of-way or the authority allows it. Native-soil nonmotorized trail is a land-manager question under 21-1205.2(a)(2)(iii). A person under 16 may not operate a Class 3 on a public highway.
